Karnataka HC Quashes Goonda Act Detention Without Evidence

The Karnataka High Court has set aside a detention order under the Goonda Act, stating that claims of activities prejudicial to public order require supporting evidence. A division bench allowed a habeas corpus petition filed by the wife of Sanju Vitthal Kadkol, who was detained for alleged habitual offenses. The court noted Kadkol was out on bail in pending cases and had been acquitted in one.

कर्नाटक हाई कोर्ट ने गुंडा एक्ट के तहत नज़रबंदी के आदेश को रद्द कर दिया है। कोर्ट ने कहा कि सार्वजनिक व्यवस्था के लिए हानिकारक गतिविधियों के दावों के लिए सबूत की ज़रूरत होती है। एक डिवीज़न बेंच ने संजू विट्ठल कडकोल की पत्नी की habeas corpus याचिका को मंज़ूर कर लिया, जिन्हें कथित आदतन अपराधों के लिए हिरासत में लिया गया था। कोर्ट ने कहा कि कडकोल लंबित मामलों में ज़मानत पर थे और एक मामले में बरी भी हो चुके थे।
