Himachal HC Questions Forest Land Use For Muck Dumping

The Himachal Pradesh High Court has raised serious concerns regarding the identification of forest land for muck dumping near Dharamshala. A division bench questioned the basis of such identification, emphasizing the forest department's primary role in protecting forest land from diversion. The court noted that five of the six identified muck dumping sites are on forest land, requiring permissions under the Forest Rights Act and Forest Conservation Act. Authorities were questioned about efforts to find alternative land and directed to file detailed affidavits on the matter.

हिमाचल प्रदेश हाई कोर्ट ने धर्मशाला के पास मलबे के ढेर के लिए वन भूमि की पहचान को लेकर गंभीर चिंता जताई है। एक खंडपीठ ने ऐसी पहचान के आधार पर सवाल उठाए, वन भूमि को डायवर्जन से बचाने में वन विभाग की प्राथमिक भूमिका पर जोर दिया। अदालत ने कहा कि पहचानी गई छह मलबे डंपिंग साइटों में से पांच वन भूमि पर हैं, जिनके लिए वन अधिकार अधिनियम और वन संरक्षण अधिनियम के तहत अनुमति की आवश्यकता होगी। अधिकारियों से वैकल्पिक भूमि खोजने के प्रयासों के बारे में सवाल किया गया और इस मामले पर विस्तृत हलफनामा दाखिल करने का निर्देश दिया गया।
