Madras HC Quashes Detention Under Goondas Act Due To Delay
TOI - Delhi · india
The Madras High Court has ruled that a direct and current connection between the reasons for detention and the purpose of arrest is essential under the Goondas Act. A division bench quashed a detention order against D Anand, citing a significant one-month delay between his arrest and the order's issuance. The court emphasized that such unexplained delays can sever the necessary link, casting doubt on the detaining authority's genuine satisfaction. This ruling came after Anand's mother filed a habeas corpus petition, arguing the delay vitiated the detention.
