Kerala HC Quashes Police Association Bifurcation Order

The Kerala High Court has quashed the bifurcation of the Kerala Police Officers Association (KPOA) and its merger with other police associations. Justice Bechu Kurian Thomas ruled that the government lacked the authority to restructure these associations. The court found that the Additional Chief Secretary's order, which divided KPOA assets and created ad hoc committees, was invalid. The High Court emphasized that recognised associations are entitled to ensure their by-laws are not violated, even by the government.

केरल हाई कोर्ट ने केरल पुलिस ऑफिसर्स एसोसिएशन (KPOA) के बंटवारे और उसे अन्य पुलिस एसोसिएशनों के साथ मिलाने के आदेश को रद्द कर दिया है। जस्टिस बेचु कुरियन थॉमस ने फैसला सुनाया कि सरकार के पास इन एसोसिएशनों का पुनर्गठन करने का अधिकार नहीं था। कोर्ट ने पाया कि एडिशनल चीफ सेक्रेटरी का आदेश, जिसने KPOA की संपत्ति को बांटा और तदर्थ समितियां बनाईं, अमान्य था। हाई कोर्ट ने इस बात पर जोर दिया कि मान्यता प्राप्त एसोसिएशनों को यह सुनिश्चित करने का अधिकार है कि उनके उपनियमों का उल्लंघन न हो, भले ही सरकार द्वारा किया गया हो।
