Legislature's Declaration on Law Amendments Can Cut Litigation, Says HC
Times of India · india
The Karnataka High Court has suggested that legislative declarations on the prospective or retrospective application of amended laws would significantly reduce litigation. Justice Anant Ramanath Hegde noted that such clarity, when included within the amendment itself, can prevent delays and improve justice administration. The court highlighted the issue after encountering numerous conflicting verdicts on the retrospective application of laws, specifically referencing an amendment to Section 17A of the Prevention of Corruption Act. This amendment requires prior sanction to prosecute public servants.
