ITAT Quashes Rs 2.51 Crore Addition as Reassessment Notice Issued 5 Days Late

The Income Tax Appellate Tribunal (ITAT), Chennai, has quashed a reassessment involving Rs 2.51 crore in additions. The tribunal ruled that the Income Tax Department issued the reopening notice after the statutory time limit had expired. The case involved a man who did not file his income tax return for assessment year 2015-16. The Assessing Officer issued a notice under Section 148 on April 5, 2022, for unexplained income, including a Rs 2 crore time deposit. The ITAT found the reassessment proceedings for AY 2015-16 were time-barred under pre-amendment laws.

आयकर अपीलीय न्यायाधिकरण (ITAT), चेन्नई ने 2.51 करोड़ रुपये की अतिरिक्त राशि से जुड़े पुनर्मूल्यांकन को रद्द कर दिया है। न्यायाधिकरण ने फैसला सुनाया कि आयकर विभाग ने वैधानिक समय सीमा समाप्त होने के बाद पुनर्मूल्यांकन नोटिस जारी किया था। इस मामले में एक व्यक्ति शामिल था जिसने आकलन वर्ष 2015-16 के लिए अपना आयकर रिटर्न दाखिल नहीं किया था। आकलन अधिकारी ने 2 करोड़ रुपये की समय जमा राशि सहित अघोषित आय के लिए 5 अप्रैल 2022 को धारा 148 के तहत नोटिस जारी किया था। ITAT ने पाया कि AY 2015-16 के लिए पुनर्मूल्यांकन कार्यवाही पूर्व-संशोधन कानूनों के तहत समय-वर्जित थी।
