Global Investors Oppose Tax Officials' Use of Judicial Anti-Avoidance Rule

International investors have expressed concerns to Indian tax authorities regarding the use of the 'judicial anti-avoidance rule' (JAAR) by Income-tax officials to deny tax reliefs. They are seeking government intervention to address this issue, which affects foreign direct investors like MNCs and private equity houses. The rule was invoked to reject tax benefits for at least three Mauritius investors on the sale of 'grandfathered shares' acquired before April 1, 2017. Investors argue that using JAAR after GAAR was prohibited for such shares is a retrograde step, contradicting New Delhi's intent.
