Delhi HC Grants Divorce Before 1 Year Separation Period Over Lack of Physical Intimacy

The Delhi High Court has granted a divorce to a couple married for five months, waiving the mandatory one-year separation period. The couple, who lived together for 84 days, sought divorce citing a lack of physical intimacy and irreconcilable differences. The Family Court had previously rejected their plea, questioning the reason for the absence of physical relations. However, the High Court bench, comprising Justices Vivek Chaudhary and Renu Bhatnagar, ruled that a one-year wait is not appropriate for young individuals facing such circumstances, allowing them to start new lives.

दिल्ली हाईकोर्ट ने पांच महीने से विवाहित एक जोड़े को तलाक की मंजूरी दे दी है, और अनिवार्य एक साल की अलगाव अवधि को माफ कर दिया है। 84 दिनों तक साथ रहने वाले इस जोड़े ने शारीरिक संबंध की कमी और अनमेल मतभेदों का हवाला देते हुए तलाक मांगा था। फैमिली कोर्ट ने पहले उनकी याचिका खारिज कर दी थी, शारीरिक संबंध की अनुपस्थिति के कारण पर सवाल उठाते हुए। हालांकि, जस्टिस विवेक चौधरी और जस्टिस रेणु भटनागर की पीठ ने फैसला सुनाया कि ऐसे हालात का सामना कर रहे युवा व्यक्तियों के लिए एक साल का इंतजार उचित नहीं है, जिससे उन्हें नया जीवन शुरू करने की अनुमति मिल सके।
