ITAT in Ahmedabad has ruled that taxpayers withdrawing political donation claims during reassessment will not face penalties for misreporting income. This decision applies to assessment year 2019-20, amid increased scrutiny of political donations. The tribunal stated that a claim's subsequent withdrawal or disallowance does not automatically constitute misreporting under Section 270A of the Income-tax Act. It emphasized that deliberate wrongdoing must be established before invoking higher penalties, offering relief to taxpayers in such cases.

अहमदाबाद में ITAT ने फैसला सुनाया है कि पुनर्मूल्यांकन के दौरान राजनीतिक चंदा दावों को वापस लेने वाले करदाताओं पर आय की गलत रिपोर्टिंग के लिए जुर्माना नहीं लगाया जाएगा। यह फैसला असेसमेंट ईयर 2019-20 के लिए है, जब राजनीतिक चंदे पर कड़ी नज़र रखी जा रही थी। ट्रिब्यूनल ने कहा कि किसी दावे को बाद में वापस लेना या अस्वीकार करना, इनकम-टैक्स एक्ट के सेक्शन 270A के तहत अपने आप में गलत रिपोर्टिंग नहीं है। इसने जोर देकर कहा कि ऊंचे जुर्माने लगाने से पहले जानबूझकर गलत काम साबित होना चाहिए, जिससे ऐसे मामलों में करदाताओं को राहत मिली है।
