Court: Governor's Premature Release Power Not Arbitrary

A court bench comprising Justices J J Munir and Tarun Saxena has stated that a Governor's power to grant premature release cannot be exercised arbitrarily. This observation came as the court quashed an order that had denied premature release to a convict. The convict had been sentenced to seven years of rigorous imprisonment.

कोर्ट: राज्यपाल की समयपूर्व रिहाई की शक्ति मनमानी नहीं

जस्टिस जे जे मुनीर और तरुण सक्सेना की बेंच ने कहा है कि राज्यपाल की समय से पहले रिहाई देने की शक्ति मनमानी नहीं हो सकती। यह बात तब कही गई जब कोर्ट ने एक दोषी की समय से पहले रिहाई से इनकार करने वाले आदेश को रद्द कर दिया। उस दोषी को सात साल की कड़ी कैद की सजा सुनाई गई थी।
