Freedom of Religion Doesn't Guarantee Cemetery Land: Allahabad HC

The Allahabad High Court has ruled that the freedom of religion does not guarantee a community the right to a specific plot of land for a cemetery. A division bench dismissed a plea by a Christian body seeking a burial ground in Ghaziabad. The court stated that converting local body land for a graveyard is an executive decision based on various factors. While authorities can consider such requests if there's a shortage of space, they are not obligated to allocate land.

इलाहाबाद हाईकोर्ट ने फैसला सुनाया है कि धर्म की स्वतंत्रता किसी समुदाय को कब्रिस्तान के लिए जमीन के एक खास टुकड़े का अधिकार नहीं देती है। एक डिविजन बेंच ने गाजियाबाद में कब्रिस्तान की मांग करने वाले एक ईसाई संगठन की याचिका खारिज कर दी। कोर्ट ने कहा कि स्थानीय निकाय की जमीन को कब्रिस्तान के लिए बदलना कई कारकों पर आधारित एक कार्यकारी निर्णय है। हालांकि अधिकारी जगह की कमी होने पर ऐसे अनुरोधों पर विचार कर सकते हैं, लेकिन वे जमीन आवंटित करने के लिए बाध्य नहीं हैं।
