Despite the anti-defection law enacted in 1985, these elected representatives are changing loyalties. The law disqualifies members who voluntarily leave their party or defy party whips. However, provisions like party mergers allow many to evade disqualification, raising questions about the law's effectiveness in curbing political defections.

एडीआर और नेशनल इलेक्शन वॉच की रिपोर्ट बताती है कि 2022 से 2026 के बीच 111 सांसद और विधायक दल बदल चुके हैं। इनमें 24 लोकसभा सांसद, 7 राज्यसभा सांसद और 78 विधायक शामिल हैं। 1985 में दल-बदल कानून बनने के बावजूद ये चुने हुए प्रतिनिधि निष्ठा बदल रहे हैं। कानून के तहत पार्टी छोड़ने या व्हिप का उल्लंघन करने पर अयोग्यता होती है। लेकिन, पार्टी विलय जैसे प्रावधानों से कई बच निकलते हैं, जिससे कानून की प्रभावशीलता पर सवाल उठते हैं।
