Delhi HC Rules Couples With Two Children Can't Adopt Normal Infants

The Delhi High Court has clarified that prospective adoptive parents with two or more children are ineligible to adopt a "normal" child under the Adoption Regulations, 2022. Justice Swarana Kanta Sharma stated that such couples can only be considered for children with special needs or those classified as hard to place, unless exceptions apply for relatives or step-children. The ruling came in response to a petition challenging the withdrawal of an adoption referral for an infant.

दिल्ली हाईकोर्ट ने साफ किया है कि दो या उससे ज़्यादा बच्चे वाले संभावित गोद लेने वाले माता-पिता, एडॉप्शन रेगुलेशंस, 2022 के तहत 'सामान्य' बच्चे को गोद लेने के अयोग्य हैं। जस्टिस स्वर्ण कांता शर्मा ने कहा कि ऐसे जोड़ों पर केवल विशेष ज़रूरतों वाले बच्चों या जिन्हें गोद लेना मुश्किल माना जाता है, उनके लिए ही विचार किया जा सकता है, जब तक कि रिश्तेदारों या सौतेले बच्चों के लिए कोई अपवाद लागू न हो। यह फैसला एक शिशु के लिए गोद लेने के रेफरल को वापस लेने को चुनौती देने वाली याचिका के जवाब में आया।
