US Court Upholds Detention of Indian Green Card Holder With Criminal Record

An Indian national, Yogesh Chandaben Dabhi, who holds a US Green Card, challenged his detention by the Department of Homeland Security. The DHS revealed Dabhi had two criminal convictions resulting in a total of seven years of confinement. The government argued his detention was lawful as he was considered an inadmissible alien upon returning to the US. अमेरिकी ग्रीन कार्ड रखने वाले भारतीय नागरिक, योगेश चंदाबेन डाभी ने डिपार्टमेंट ऑफ होमलैंड सिक्योरिटी द्वारा अपनी हिरासत को चुनौती दी थी। DHS ने खुलासा किया कि डाभी को दो आपराधिक दोषसिद्धि हुई थी जिसके परिणामस्वरूप कुल सात साल की कैद हुई। सरकार ने तर्क दिया कि उसकी हिरासत वैध थी क्योंकि अमेरिका लौटने पर उसे एक अस्वीकार्य एलियन माना गया था। अदालत ने डाभी के इस तर्क को खारिज कर दिया कि उसे उचित प्रक्रिया से वंचित किया गया था, और उसके आप्रवासन की स्थिति और आपराधिक इतिहास के आधार पर उसे हिरासत में रखने के सरकार के अधिकार का पक्ष लिया।
