Delhi HC: Child Referral Doesn't Guarantee Adoption If Parents Are Ineligible
Hindustan Times · india
The Delhi High Court has ruled that accepting a child referral does not grant prospective adoptive parents an enforceable right to adoption if they are legally ineligible. The court dismissed a plea from a Singapore-based man challenging the rejection of his inter-country adoption application by CARA. CARA had rejected the application because the couple had two biological children, making them eligible only for special needs or hard-to-place children under adoption regulations. The court clarified that an expectation based on actions contrary to regulations cannot be considered a legitimate legal expectation.
