Delhi HC Rules Bar Council Cannot Unrestrictedly Remove Advocates' Names

The Delhi High Court has ruled that the Bar Council of India (BCI) cannot arbitrarily remove an advocate's name from its rolls solely based on a disputed or fabricated caste certificate submitted during enrolment. Justice Swarna Kanta Sharma clarified that establishing fraud requires demonstrating that it materially contributed to the advocate's enrolment. The court emphasized that not every incorrect statement constitutes misrepresentation of an essential fact. This verdict came while hearing a petition by advocate Dipinder Kaur, whose name was removed by the BCI.

दिल्ली हाईकोर्ट ने फैसला सुनाया है कि बार काउंसिल ऑफ इंडिया (BCI) किसी वकील का नाम सिर्फ दाखिले के समय जमा किए गए विवादित या जाली जाति प्रमाण पत्र के आधार पर मनमाने ढंग से नहीं हटा सकती। जस्टिस स्वर्ण कांता शर्मा ने साफ किया कि धोखाधड़ी साबित करने के लिए यह दिखाना ज़रूरी है कि इससे वकील के दाखिले पर असर पड़ा हो। कोर्ट ने ज़ोर दिया कि हर गलत बयान धोखाधड़ी नहीं होता। यह फैसला वकील दीपेंद्र कौर की याचिका पर आया, जिनका नाम BCI ने हटा दिया था।
