Rera Upholds Flat Cancellation, Orders Partial Refund to Buyers

Haryana Real Estate Regulatory Authority (HRera) has upheld the termination of a flat allotment in ATS Marigold, Gurgaon, due to the buyers' default on payments. The buyers had booked a 1,750 sqft apartment for Rs 96 lakh in November 2020 and paid over Rs 10 lakh. Despite reminders, they failed to make possession-linked payments, leading to allotment termination in February 2021. HRera rejected the buyers' plea for possession and delayed-possession interest but directed the builder to refund their money after deducting 10% of the sale price as earnest money.
