Landowner Loses Tax Case Over Rs 6 Crore Sale Of Transferable Development Rights

Times of India - Business · business

A landowner who surrendered part of his property for road widening and received Transferable Development Rights (TDRs) has lost a tax appeal. He sold these TDRs for Rs 6.02 crore, believing the proceeds were non-taxable capital receipts. However, the Income Tax Appellate Tribunal (ITAT) Bangalore ruled that the sale of TDRs is taxable as capital gains. The tribunal directed the tax officer to allow credit for the cost attributable to the surrendered land. This decision clarifies the taxability of TDRs in India.
