Madras HC Dismisses Plea Against Resigned MLAs

The Madras High Court has dismissed a public interest litigation seeking to prevent resigned MLAs from recontesting in upcoming byelections. The court stated it cannot direct the Election Commission to impose a cooling-off period or make resigned legislators bear bypoll expenses. It emphasized that such policy decisions fall under the purview of Parliament. The petitioner aimed to curb wastage of public money due to resignations and re-elections, often to evade anti-defection laws.

मद्रास HC ने इस्तीफा दिए विधायकों के खिलाफ याचिका खारिज की

मद्रास हाई कोर्ट ने एक जनहित याचिका खारिज कर दी है। इसमें इस्तीफा देने वाले विधायकों को उपचुनाव लड़ने से रोकने की मांग की गई थी। कोर्ट ने कहा कि वह चुनाव आयोग को कूलिंग-ऑफ पीरियड लागू करने या इस्तीफा देने वाले विधायकों से उपचुनाव का खर्च वसूलने का निर्देश नहीं दे सकता। कोर्ट ने जोर दिया कि ऐसे नीतिगत फैसले संसद के अधिकार क्षेत्र में आते हैं। याचिकाकर्ता का मकसद इस्तीफे और दोबारा चुनाव से जनता के पैसे की बर्बादी रोकना था।
