Calcutta High Court Dismisses Partition Appeal Over Unproven Title
Times of India · india
The Calcutta High Court has dismissed an appeal challenging the rejection of a partition suit, upholding the trial court's decision. The plaintiff, Safikul Islam Khan, failed to establish any right, title, interest, or possession over the disputed 41-decimal property. The Division Bench noted that necessary parties with rights in the property were not included in the suit. Competing accounts of ownership and prior partitions were presented by both sides, but the court found no legal infirmity in the original dismissal.
