NY Court Rules Husband's Loan Debt Paid From Joint Home Sale

A New York appeals court has ruled that a husband who took out a loan against his pre-marital home to buy a joint marital property is entitled to have that debt repaid from the sale proceeds of the marital home. The New York Supreme Court, Appellate Division, First Department, issued the ruling on October 22 in the Menkes v Menkes divorce case. The court clarified that debts incurred by one spouse to purchase shared marital assets are considered joint liabilities.

न्यूयॉर्क की एक अपीलीय अदालत ने फैसला सुनाया है कि जिस पति ने अपनी शादी से पहले के घर पर लोन लेकर संयुक्त वैवाहिक संपत्ति खरीदी थी, उसे उस कर्ज को वैवाहिक घर की बिक्री से मिलने वाले पैसों से चुकाने का हक है। न्यूयॉर्क सुप्रीम कोर्ट, अपीलीय डिवीजन, फर्स्ट डिपार्टमेंट ने 22 अक्टूबर को मेन्केस बनाम मेन्केस तलाक मामले में यह फैसला सुनाया। अदालत ने स्पष्ट किया कि एक साथी द्वारा साझा वैवाहिक संपत्ति खरीदने के लिए लिया गया कर्ज संयुक्त देनदारी माना जाएगा।
