Allahabad HC: Police cannot detain family to pressure accused into surrender

The Allahabad High Court has ruled that police cannot detain the family members of an accused to pressure them into surrendering. The court ordered ₹40,000 compensation to a man illegally detained for four days without any connection to the case against his brother. Justices Atul Sreedharan and Divesh Chandra Samant stated such detention is an unlawful deprivation of liberty. The compensation will be recovered from the salaries of the responsible police personnel.

इलाहाबाद हाई कोर्ट ने फैसला सुनाया है कि पुलिस आरोपी के परिवार के सदस्यों को सरेंडर करने के लिए दबाव डालने के लिए हिरासत में नहीं ले सकती। कोर्ट ने एक ऐसे व्यक्ति को चार दिनों तक अवैध रूप से हिरासत में रखने के लिए ₹40,000 का मुआवजा देने का आदेश दिया, जिसका उसके भाई के खिलाफ मामले से कोई संबंध नहीं था। जस्टिस अतुल श्रीधरन और दिवेश चंद्र सामंत ने कहा कि ऐसी हिरासत स्वतंत्रता का गैरकानूनी हनन है। मुआवजा जिम्मेदार पुलिस कर्मियों के वेतन से वसूला जाएगा।
