Reliance Communications' resolution professional has filed a curative petition in the Supreme Court, challenging a February ruling that excluded spectrum as an asset under the Insolvency and Bankruptcy Code. The petition argues the verdict causes irreversible harm by stripping banks of assets against which they lent, potentially leaving them with no recourse for thousands of crores advanced. It warns this sectoral exception could extend to other vital sectors like mining and oil licenses.

रिलायंस कम्युनिकेशंस के रेजोल्यूशन प्रोफेशनल ने सुप्रीम कोर्ट में एक क्यूरेटिव पिटीशन दायर की है, जिसमें फरवरी के उस फैसले को चुनौती दी गई है जिसने Insolvency and Bankruptcy Code के तहत स्पेक्ट्रम को एक संपत्ति के रूप में शामिल नहीं किया था। पिटीशन में कहा गया है कि यह फैसला बैंकों को उन संपत्तियों से वंचित करके अपरिवर्तनीय नुकसान पहुंचाता है जिनके आधार पर उन्होंने कर्ज दिया था, जिससे उन्हें हजारों करोड़ के एडवांस के लिए कोई उपाय नहीं मिल सकता है। इसमें चेतावनी दी गई है कि यह क्षेत्रीय अपवाद माइनिंग और तेल लाइसेंस जैसे अन्य महत्वपूर्ण क्षेत्रों तक फैल सकता है।
