ITAT Rules Father Not Liable For Minor's Income

The Income Tax Appellate Tribunal (ITAT) Delhi has ruled that a father cannot be penalised under Section 270A for his minor child's interest income if his declared income matches the assessed income. The penalty of Rs 12.83 lakh was levied on a New Delhi man after his minor child's Rs 1.17 crore interest income was clubbed with his own. The tribunal found the penalty unjustified as the dispute was over tax treaty.

आयकर अपीलीय न्यायाधिकरण (ITAT) दिल्ली ने फैसला सुनाया है कि अगर पिता की घोषित आय, आकलन की गई आय से मेल खाती है, तो उसे अपने नाबालिग बच्चे की ब्याज आय पर धारा 270A के तहत दंडित नहीं किया जा सकता। नई दिल्ली के एक व्यक्ति पर 12.83 लाख रुपये का जुर्माना लगाया गया था, क्योंकि उसके नाबालिग बच्चे की 1.17 करोड़ रुपये की ब्याज आय को उसकी आय में जोड़ा गया था।
