राजस्थान हाईकोर्ट ने फैसला सुनाया है कि लंबे समय तक बिना किसी ठोस वजह के शारीरिक संबंध बनाने से इनकार करना मानसिक क्रूरता माना जा सकता है, जो तलाक का आधार बन सकता है। कोर्ट ने एक पति के तलाक के फैसले को बरकरार रखा, साथ ही हिंदू विवाह अधिनियम के तहत पत्नी द्वारा कथित तौर पर आत्महत्या की धमकी को भी मानसिक क्रूरता बताया। इस जोड़े की शादी 2018 में हुई थी, और पति ने पत्नी के ताने मारने, शारीरिक संबंध बनाने से इनकार करने और अक्टूबर 2018 से अलग रहने के आधार पर तलाक मांगा था। पत्नी ने वित्तीय दबाव और वैवाहिक जिम्मेदारियों को पूरा न करने का आरोप लगाते हुए इसका विरोध किया।
