HC Refuses to Quash Pocso Act Case Over Compromise

The Punjab and Haryana High Court has dismissed a plea to quash a case registered under the Pocso Act and Bharatiya Nyaya Sanhita against a man accused of making obscene gestures and offering money to minor girls. The court stated that a compromise between private parties cannot override public interest or the legislative intent of the Pocso Act. The accused had sought quashing based on an alleged amicable resolution with the complainants.

पंजाब और हरियाणा हाई कोर्ट ने एक आदमी के खिलाफ पोक्सो एक्ट और भारतीय न्याय संहिता के तहत दर्ज केस को रद्द करने की याचिका खारिज कर दी है। उस आदमी पर नाबालिग लड़कियों को अश्लील इशारे करने और पैसे देने का आरोप है। कोर्ट ने कहा कि निजी पक्षों के बीच समझौता, सार्वजनिक हित या पोक्सो एक्ट के विधायी इरादे को ओवरराइड नहीं कर सकता। आरोपी ने कथित तौर पर शिकायतकर्ताओं के साथ सौहार्दपूर्ण समाधान के आधार पर केस रद्द करने की मांग की थी।
