Juvenile Justice Act Needs Focus On Children, Not Just Crimes

Chief Justice of India Surya Kant stated that while the Juvenile Justice Act allows 16-18 year olds to be tried as adults for serious offences, the law must remember they are still children. Speaking at a Supreme Court consultation on the act's 10 years, he emphasized restoration over retribution for children in conflict with the law. Justice BV Nagarathna highlighted that the system must not treat children as mere statistics, stressing implementation challenges.

भारत के मुख्य न्यायाधीश सूर्य कांत ने कहा कि किशोर न्याय अधिनियम 16-18 साल के किशोरों को गंभीर अपराधों के लिए वयस्कों की तरह सज़ा देने की इजाज़त देता है, लेकिन कानून को यह याद रखना चाहिए कि वे अभी भी बच्चे हैं। अधिनियम के 10 साल पूरे होने पर सुप्रीम कोर्ट में हुई एक बैठक में उन्होंने कहा कि कानून के साथ संघर्ष कर रहे बच्चों के लिए सज़ा से ज़्यादा सुधार पर ज़ोर देना चाहिए। न्यायमूर्ति बीवी नागरत्ना ने इस बात पर ज़ोर दिया कि सिस्टम को बच्चों को सिर्फ आंकड़ों के तौर पर नहीं देखना चाहिए और उन्होंने इसे लागू करने में आने वाली दिक्कतों पर भी प्रकाश डाला।
