Bombay HC: WhatsApp Video of SC/ST Person Falls Under Atrocities Act

The Bombay High Court has ruled that circulating a video of an SC/ST community member on WhatsApp constitutes "public view" and attracts provisions of the SC/ST (Prevention of Atrocities) Act. Justice Yanshivraj Khobragade stated that the material on record was sufficient to constitute an offence under the Act. The court dismissed a bail plea for appellant Nikhil Thepale, who faces charges including those under the Bharatiya Nyaya Sanhita and the IT Act. Thepale had allegedly recorded and circulated videos of the victim after being refused favours.

बॉम्बे हाईकोर्ट ने फैसला सुनाया है कि व्हाट्सएप पर एससी/एसटी समुदाय के सदस्य का वीडियो प्रसारित करना 'सार्वजनिक दृश्य' माना जाएगा और यह एससी/एसटी (अत्याचार निवारण) अधिनियम के प्रावधानों को आकर्षित करेगा। जस्टिस यंशिवराज खोबरागड़े ने कहा कि रिकॉर्ड पर मौजूद सामग्री अधिनियम के तहत अपराध गठित करने के लिए पर्याप्त थी। अदालत ने आरोपी निखिल थेपले की जमानत याचिका खारिज कर दी, जिस पर भारतीय न्याय संहिता और आईटी अधिनियम के तहत आरोप लगे हैं। थेपले पर कथित तौर पर पीड़ित से पक्षपात करने से इनकार करने के बाद उसका वीडियो रिकॉर्ड करने और प्रसारित करने का आरोप है।
