Marital Discord Not Ground For Abortion, Supreme Court Tells Woman

The Supreme Court on Monday indicated that marital discord alone is not sufficient grounds for terminating a pregnancy beyond six months. A bench questioned the societal implications if women could abort due to alleged mistreatment by husbands or in-laws. The court emphasized that the father also has rights over the unborn child, especially when the fetus is healthy. It urged the petitioner to reconsider abortion, suggesting that normal marital arguments should not lead to such decisions. The court is seeking rapprochement by asking the husband to withdraw character allegations.

सुप्रीम कोर्ट ने सोमवार को संकेत दिया कि छह महीने से अधिक की गर्भावस्था को समाप्त करने के लिए केवल वैवाहिक कलह पर्याप्त आधार नहीं है। एक पीठ ने इस बात पर सवाल उठाया कि अगर महिलाएं पतियों या ससुराल वालों द्वारा कथित दुर्व्यवहार के कारण गर्भपात करा सकती हैं तो इसके सामाजिक निहितार्थ क्या होंगे। अदालत ने इस बात पर जोर दिया कि अजन्मे बच्चे पर पिता का भी अधिकार होता है, खासकर जब भ्रूण स्वस्थ हो। इसने याचिकाकर्ता से गर्भपात पर पुनर्विचार करने का आग्रह किया, यह सुझाव देते हुए कि सामान्य वैवाहिक झगड़ों से ऐसे निर्णय नहीं लिए जाने चाहिए। अदालत पति से चरित्र आरोपों को वापस लेने के लिए कहकर सुलह की मांग कर रही है।
