SC Quashes NSA Detention, Imposes Cost

The Supreme Court has quashed the National Security Act detention of Mulla Afroz, who was accused of organising the Sambhal violence. Justices Dipankar Datta and Sheel Nagu stated that a confessional statement alone cannot be the sole basis for detention. Afroz was arrested 54 days after the violence and later granted bail by the Allahabad High Court, but the Uttar Pradesh government then ordered his detention under the NSA. The court also imposed a cost of Rs 10 lakh on the state government.

सुप्रीम कोर्ट ने NSA नज़रबंदी रद्द की, लगाया जुर्माना

सुप्रीम कोर्ट ने मुल्ला अफरोज की National Security Act के तहत नज़रबंदी रद्द कर दी है, जिन पर संभल हिंसा आयोजित करने का आरोप था। जस्टिस दिपांकर दत्ता और शील नागू ने कहा कि सिर्फ कबूलनामे के आधार पर नज़रबंदी नहीं की जा सकती। अफरोज को हिंसा के 54 दिन बाद गिरफ्तार किया गया था और बाद में Allahabad High Court ने उन्हें ज़मानत दे दी थी, लेकिन उत्तर प्रदेश सरकार ने तब NSA के तहत उनकी नज़रबंदी का आदेश दिया था। कोर्ट ने राज्य सरकार पर 10 लाख रुपये का जुर्माना भी लगाया है।
