Allahabad HC Suspends DM's Fair Order, Cites Usurpation of Power

The Allahabad High Court has suspended an order by the Bijnor District Magistrate concerning the management of the traditional Jaahar Divan fair. A division bench stated that District Magistrates cannot act as 'plenipotentiaries' and must not usurp the jurisdiction of other officers or judges. The court found the DM's order, which handed fair management to the Gaon Sabha, to be prima facie without jurisdiction and in conflict with a previous civil court decree. The petitioners were permitted to organize the fair pending further hearings.

इलाहाबाद हाईकोर्ट ने बिजनौर के जिला मजिस्ट्रेट (डीएम) के पारंपरिक जाहर दीवान मेले के प्रबंधन से जुड़े एक आदेश पर रोक लगा दी है। एक डिविजन बेंच ने कहा कि जिला मजिस्ट्रेट 'पूर्ण अधिकारी' के तौर पर काम नहीं कर सकते और उन्हें दूसरे अधिकारियों या जजों के अधिकार क्षेत्र में दखल नहीं देना चाहिए। कोर्ट ने पाया कि डीएम का आदेश, जिसमें मेले का प्रबंधन ग्राम सभा को सौंपा गया था, प्रथम दृष्टया अधिकार क्षेत्र से बाहर था और एक पिछले सिविल कोर्ट के फैसले के विपरीत था। याचिकाकर्ताओं को आगे की सुनवाई लंबित रहने तक मेले का आयोजन करने की अनुमति दी गई।
