Tax Tribunal Rules on Genuine Cash Gifts From Family Members
Business Standard · business
The Jaipur Bench of the Income Tax Appellate Tribunal (ITAT) has deleted an addition of ₹13.04 lakh for unexplained cash deposits, ruling in favour of a taxpayer who received a gift from his mother. The tribunal accepted a notarised gift deed, witness testimony, and jewellery valuation report as evidence of the gift's genuineness. While gifts from specified relatives are tax-exempt, taxpayers must maintain proper records to prove the source of funds and the donor's financial capacity.
