The Supreme Court has permitted a mother to relocate her two minor children to the United Kingdom for schooling. The court ruled that the father, who is facing prosecution under the POCSO Act, could not be granted custody while criminal proceedings are ongoing. Justices Vikram Nath and Sandeep Mehta also expunged the Delhi High Court's observations questioning the POCSO FIR, deeming them premature. The High Court had previously affirmed the father's custody and rejected the mother's relocation request, citing her perceived 'nomadic' lifestyle.

सुप्रीम कोर्ट ने एक माँ को अपने दो नाबालिग बच्चों को पढ़ाई के लिए यूनाइटेड किंगडम ले जाने की अनुमति दे दी है। कोर्ट ने कहा कि पिता, जिन पर POCSO एक्ट के तहत मुकदमा चल रहा है, उन्हें आपराधिक कार्यवाही के दौरान हिरासत नहीं दी जा सकती। जस्टिस विक्रम नाथ और संदीप मेहता ने दिल्ली हाई कोर्ट की उन टिप्पणियों को भी हटा दिया, जिनमें POCSO FIR पर सवाल उठाए गए थे और उन्हें समय से पहले बताया था। हाई कोर्ट ने पहले पिता की हिरासत की पुष्टि की थी और माँ के 'घुमंतू' जीवनशैली के कारण उनके बच्चों को कहीं और ले जाने के अनुरोध को खारिज कर दिया था।
