Supreme Court Rules Assembly Tenure Cannot Delay Defection Pleas

Hindustan Times · politics

The Supreme Court has ruled that petitions under the anti-defection law must be decided promptly, stating that remaining assembly tenure is not a valid reason to delay them. The court directed the Madhya Pradesh assembly speaker to decide a disqualification petition against Congress MLA Nirmala Sapre within two months. This decision emphasizes that issues arising under the Tenth Schedule of the Constitution require swift resolution, referencing previous judgments that set a general three-month limit for such cases. The ruling aims to prevent anti-defection proceedings from languishing indefinitely.
