Govt Employee Cannot Rejoin After Poll Loss

The Rajasthan High Court has ruled that government employees who resign to contest elections cannot seek reinstatement, regardless of the outcome. A division bench dismissed a former railway auditor's plea, stating that losing an election is not a compelling reason for withdrawal of resignation. The court also noted that active political participation breaches mandatory political neutrality rules for civil servants.

राजस्थान हाई कोर्ट ने फैसला सुनाया है कि चुनाव लड़ने के लिए इस्तीफा देने वाले सरकारी कर्मचारियों को, चाहे नतीजा कुछ भी हो, दोबारा नौकरी पर बहाल नहीं किया जाएगा। एक बेंच ने पूर्व रेलवे ऑडिटर की याचिका खारिज करते हुए कहा कि चुनाव हारना इस्तीफा वापस लेने का कोई खास कारण नहीं है। कोर्ट ने यह भी कहा कि सक्रिय राजनीतिक भागीदारी सिविल सेवकों के लिए अनिवार्य राजनीतिक तटस्थता नियमों का उल्लंघन करती है।
