India's Constitution Guarantees Right to Protest, With Reasonable Restrictions
Aaj Tak · politics
India's Constitution grants citizens the fundamental right to express their views and protest peacefully. Article 19(1)(a) ensures freedom of speech and expression, while Article 19(1)(b) allows for peaceful assembly. However, these rights are not absolute and can be subject to reasonable restrictions under Article 19(2) for reasons like national security and public order. The Supreme Court has clarified that while protest is a right, indefinite occupation of public spaces is not permissible, emphasizing that rights and duties go hand-in-hand.
