Chhattisgarh HC Upholds Divorce, Allows Wife Separate Alimony Claim

The Chhattisgarh High Court has upheld a divorce granted to a husband on grounds of mental cruelty, stating the wife's conduct constituted cruelty. The couple married in February 2016, and the husband sought divorce alleging frequent quarrels and infidelity. The wife denied this, claiming harassment and dowry demands from her in-laws. While the family court granted the divorce, it denied alimony. The High Court, however, ruled the wife could pursue alimony separately as she had not adequately presented her claim or evidence in the lower court.

छत्तीसगढ़ हाईकोर्ट ने मानसिक क्रूरता के आधार पर पति को दी गई तलाक की मंजूरी को बरकरार रखा है। कोर्ट ने कहा कि पत्नी का आचरण क्रूरता के दायरे में आता है। यह जोड़ा फरवरी 2016 में शादीशुदा था और पति ने लगातार झगड़ों और बेवफाई का आरोप लगाते हुए तलाक मांगा था। पत्नी ने इन आरोपों से इनकार किया और ससुराल वालों द्वारा उत्पीड़न और दहेज की मांग का दावा किया। फैमिली कोर्ट ने तलाक मंजूर कर लिया था, लेकिन गुजारा भत्ता देने से इनकार कर दिया था।
