RBI Eases Rules for Distressed Asset Acquisition

The Reserve Bank of India has issued a clarification allowing asset reconstruction companies (ARCs) to acquire financial assets under the Insolvency and Bankruptcy Code. ARCs can now participate in IBC resolutions without meeting the ₹1,000 crore net owned funds requirement. This move broadens ARC participation, enabling smaller firms to engage as co-resolution applicants with other investors. The change aims to facilitate the resolution of distressed assets in the market.

भारतीय रिजर्व बैंक (RBI) ने एक स्पष्टीकरण जारी किया है जिससे एसेट रिकंस्ट्रक्शन कंपनियों (ARCs) को इंसॉल्वेंसी एंड बैंकरप्सी कोड (IBC) के तहत वित्तीय संपत्तियों को खरीदने की अनुमति मिल गई है। अब ARCs ₹1,000 करोड़ की नेट ओनड फंड की शर्त को पूरा किए बिना IBC समाधान में भाग ले सकती हैं। इस कदम से ARC की भागीदारी बढ़ेगी, जिससे छोटी फर्में अन्य निवेशकों के साथ मिलकर समाधान आवेदक के तौर पर शामिल हो सकेंगी। इस बदलाव का मकसद बाजार में फंसे हुए संपत्तियों के समाधान को आसान बनाना है।
