Muslim Inheritance Law Change Urged For Orphaned Grandchildren

A senior lawyer has urged the Law Commission to amend Muslim inheritance law to protect orphaned grandchildren. Under current Hanafi rules in India, children of a predeceased son may be excluded from their grandfather's property if surviving sons exist. This can leave minors without inheritance, even with substantial family wealth. The proposal suggests a compulsory bequest, or 'Wasiyya Wajibah', allowing such grandchildren to receive their deceased parent's share, limited to one-third of the net estate. This change would require parliamentary legislation, similar to provisions adopted in countries like Egypt.
