Uttarakhand HC Acquits Death-Row Convict Over Mental Health Safeguard Failures
Times of India · india
The Uttarakhand High Court has overturned the death sentence and conviction of a man accused in a triple murder case. The court found serious procedural errors, noting that mandatory safeguards for an accused with mental illness were not followed during the trial. The convict's father had alleged his son killed his mother, brother, and sister-in-law in 2014. Medical records indicated the accused suffered from psychosis and schizophrenia, yet the trial court proceeded without first determining his capacity to defend himself.
