Patna HC: Attempt Alone Doesn't Establish Rape Without Evidence

The Patna High Court has ruled that an allegation of rape cannot be established solely by the survivor's testimony without supporting medical or material evidence. Justice Sandeep Kumar stated that in the absence of injuries or disarranged clothing, such acts might only constitute an assault to outrage modesty. The court modified a lower court's conviction, acquitting Md Ainul Haq of rape and finding him guilty of indecent assault. He was fined Rs 25,000, payable to the victim.

पटना हाईकोर्ट ने फ़ैसला सुनाया है कि सिर्फ़ पीड़िता के बयान से रेप का आरोप साबित नहीं हो सकता, अगर मेडिकल या अन्य सबूत न हों। जस्टिस संदीप कुमार ने कहा कि चोट के निशान या अस्त-व्यस्त कपड़ों के बिना, ऐसे काम सिर्फ़ महिला की लज्जा भंग करने के इरादे से हमला माने जा सकते हैं। कोर्ट ने निचली अदालत के फ़ैसले में बदलाव करते हुए एमडी ऐनुल हक़ को रेप के आरोप से बरी कर दिया और उन्हें अभद्रतापूर्ण हमले का दोषी पाया। उन पर 25,000 रुपये का जुर्माना लगाया गया है, जो पीड़िता को देना होगा।
