Justice Datta highlighted a disturbing example where a father, after raping and murdering his elder daughter, later murdered his wife while on parole, yet his death sentence was reduced. This pattern of leniency, he argued, necessitates a re-evaluation of judicial lenity.

सुप्रीम कोर्ट के जस्टिस दीपांकर दत्ता ने कहा है कि कोर्ट का सज़ा सुनाने में नरमी वाला रवैया भारत में बढ़ते अपराधों की वजह बन रहा है। उन्होंने कहा कि सीमाएं तय करने की ज़रूरत है। उन्होंने ऐसे मामले बताए जहाँ मौत की सज़ा को उम्रकैद में बदल दिया गया। जस्टिस दत्ता ने एक परेशान करने वाला उदाहरण दिया जहाँ एक पिता ने अपनी बड़ी बेटी से रेप और हत्या के बाद, पैरोल पर बाहर रहते हुए अपनी पत्नी की भी हत्या कर दी, फिर भी उसकी मौत की सज़ा कम कर दी गई। उन्होंने दलील दी कि इस तरह की नरमी की वजह से न्यायिक नरमी का फिर से मूल्यांकन करने की ज़रूरत है।
