The Hindu · india

The Supreme Court has ruled that divorce decrees granted by foreign courts based on irretrievable breakdown of marriage are not legally valid in India. A bench of Justices Prashant Kumar Mishra and Shree Chandrashekhar made this observation while dismissing a man's plea to quash a bigamy and criminal conspiracy case. The court stated that such foreign decrees contravene Indian matrimonial law and grounds not recognized statutorily. The sanctity of matrimonial status cannot be undermined by 'forum non conveniens', especially when the marriage was solemnized in India.
