Kerala HC: No Automatic Assumption of Gold Entrustment

The Kerala High Court has ruled that courts should not automatically assume a bride entrusted gold to her husband or his relatives based solely on social customs. Judges must seek oral, documentary, or circumstantial evidence to determine if the gold was indeed entrusted or misappropriated.

केरल हाई कोर्ट ने कहा है कि सिर्फ सामाजिक रीति-रिवाजों के आधार पर यह नहीं मान लेना चाहिए कि दुल्हन ने अपनी शादी में सोना पति या उसके रिश्तेदारों को सौंपा था। कोर्ट को यह तय करने के लिए मौखिक, दस्तावेजी या परिस्थितिजन्य सबूत मांगने चाहिए कि सोना सचमुच सौंपा गया था या फिर उसका गबन हुआ है।
