Georgia Company Loses Appeal Over $220,000 Tax Auction Purchase

A Georgia company's attempt to recover $220,000 paid for a parcel at a tax auction has been unsuccessful. Talon Assets purchased the Atlanta property in June 2023 but later claimed the parcel did not physically exist due to a mapping error. The company sued Fulton County seeking a refund and cancellation of the tax deed. However, the Georgia Court of Appeals ruled that sovereign immunity protected the county, dismissing the lawsuit. The court found the company's request for repayment did not fall under the waiver of immunity for declaratory relief.
