Kerala HC Allows IVF Treatment For Couple Exceeding Age Limit

The Kerala High Court has permitted a couple to continue their IVF treatment even though the female partner has crossed the prescribed age limit of 50 years. The couple, aged 50 and 49, had started treatment within the permissible age range but were denied continuation by the hospital. The court allowed the petition, referencing a similar Punjab and Haryana High Court ruling. The couple has provided an undertaking to bear all associated risks. The central government counsel had opposed the plea, citing the ART Regulation Act.

केरल हाईकोर्ट ने एक जोड़े को आईवीएफ इलाज जारी रखने की इजाजत दे दी है, भले ही महिला साथी 50 साल की तय उम्र सीमा पार कर चुकी है। 50 और 49 साल के इस जोड़े ने तय उम्र सीमा के अंदर इलाज शुरू किया था, लेकिन अस्पताल ने उन्हें आगे जारी रखने से मना कर दिया था। कोर्ट ने याचिका मंजूर कर ली और पंजाब व हरियाणा हाईकोर्ट के ऐसे ही एक फैसले का हवाला दिया। जोड़े ने सभी संबंधित जोखिमों को उठाने का हलफनामा दिया है। केंद्र सरकार के वकील ने ART रेगुलेशन एक्ट का हवाला देते हुए इस याचिका का विरोध किया था।
