Kerala HC Orders Halt to Road Widening Until Affected Trees Are Identified

The Kerala High Court has directed that widening work on the Neriamangalam-Valara stretch of NH 85 must halt until a joint team from the revenue and forest departments identifies affected trees. This order comes after the NHAI sought to resume work following state government approval. The court emphasized the need for compliance with an earlier directive requiring demarcation and tree identification before commencing construction. The PIL challenging the project cited a lack of central government clearance under the Forest (Conservation) Act. The court posted the PIL for further hearing.

केरल हाईकोर्ट ने NH 85 के नेरियमंगलम-वालारा हिस्से पर सड़क चौड़ीकरण का काम तब तक रोकने का आदेश दिया है जब तक कि राजस्व और वन विभागों की एक संयुक्त टीम प्रभावित पेड़ों की पहचान नहीं कर लेती। यह आदेश तब आया जब NHAI ने राज्य सरकार की मंजूरी के बाद काम फिर से शुरू करने की मांग की थी। अदालत ने निर्माण शुरू करने से पहले सीमांकन और पेड़ की पहचान की आवश्यकता वाले पिछले निर्देश का पालन करने की आवश्यकता पर जोर दिया। इस परियोजना को चुनौती देने वाली जनहित याचिका में वन (संरक्षण) अधिनियम के तहत केंद्र सरकार की मंजूरी की कमी का हवाला दिया गया था।
