Madras HC Questions If Suppressing Small Property Purchase Vitiates Election

The Madras High Court questioned whether suppressing the purchase of a property worth a few lakhs can amount to undue influence, especially when a candidate owns assets exceeding ₹600 crore. Justice V Lakshminarayanan noted that tendering money to a voter constitutes undue influence, unlike the non-disclosure of minor property acquisitions. The court heard a plea challenging the election of minister C Joseph Vijay from the Perambur assembly constituency. The petitioner's counsel argued that contesting elections requires strict adherence to statutory requirements, as it is not a fundamental right.

मद्रास हाईकोर्ट ने सवाल उठाया कि क्या कुछ लाख रुपये की संपत्ति की खरीद को छिपाना अनुचित प्रभाव माना जा सकता है, खासकर तब जब उम्मीदवार के पास ₹600 करोड़ से ज़्यादा की संपत्ति हो। जस्टिस वी लक्ष्मीनारायणन ने कहा कि मतदाता को पैसे देना अनुचित प्रभाव है, न कि छोटी संपत्ति की खरीद का खुलासा न करना। कोर्ट ने पेराम्बुर विधानसभा सीट से मंत्री सी जोसेफ विजय के चुनाव को चुनौती देने वाली याचिका पर सुनवाई की। याचिकाकर्ता के वकील ने दलील दी कि चुनाव लड़ना कोई मौलिक अधिकार नहीं है, इसके लिए वैधानिक आवश्यकताओं का सख्ती से पालन करना ज़रूरी है।
