Woman Can Face Gang Rape Charge Without Committing Act, Rules Delhi HC

The Delhi High Court has ruled that a woman can be charged with gang rape even if she did not personally commit the act. A bench stated that the term "persons" in the gang rape provision should be interpreted in a gender-neutral manner, as someone acting with common intention doesn't need to be the one physically committing the crime. This clarifies that a woman can be charged under Section 376D of the IPC and Section 70 of the Bharatiya Nyaya Sanhita.

दिल्ली हाईकोर्ट ने फैसला सुनाया है कि एक महिला पर गैंगरेप का आरोप लगाया जा सकता है, भले ही उसने खुद वह काम न किया हो। एक बेंच ने कहा कि गैंगरेप के प्रावधान में 'व्यक्ति' शब्द को लिंग-तटस्थ तरीके से समझा जाना चाहिए, क्योंकि समान इरादे से काम करने वाले को अपराध शारीरिक रूप से करने की ज़रूरत नहीं है। इससे यह स्पष्ट होता है कि एक महिला पर IPC की धारा 376D और भारतीय न्याय संहिता की धारा 70 के तहत आरोप लगाया जा सकता है।
