Madras HC: No Tax Refund If Burden Passed

The Madras High Court has ruled that a recreation club cannot claim a refund for tax mistakenly collected by the State if the club has already recovered the amount from its members. A Division Bench stated that the doctrine of unjust enrichment does not apply to the State, as tax revenue ultimately benefits the public. The court partly allowed a club's appeal, ordering a refund of ₹6.41 lakh with interest, while denying ₹9.

मद्रास हाई कोर्ट ने कहा कि अगर किसी क्लब ने अपने सदस्यों से गलती से वसूला गया टैक्स वापस ले लिया है, तो वह राज्य से उसका रिफंड नहीं मांग सकता। कोर्ट ने कहा कि राज्य को 'अनुचित संवर्धन' के सिद्धांत से छूट है, क्योंकि टैक्स का पैसा जनता के भले के लिए ही जाता है। कोर्ट ने क्लब की अपील को आंशिक रूप से स्वीकार करते हुए ₹6.41 लाख ब्याज सहित वापस करने का आदेश दिया, लेकिन ₹9 लाख का रिफंड नहीं दिया।
